Terms of Service

Plain-English summary (not a substitute for the terms): Saidmark publishes statistical projections of NFL player performance and a public record of how those projections turned out. It is information, not advice. It is free and open. Don't scrape the live slate; the record is there to be graded. Don't bet money you blame us for.

1. What Saidmark is

Saidmark ("we," "us") provides statistical projections of NFL player performance, probability estimates, and a historical record of prior projections (the "Service").

We are not a sportsbook. We do not accept, place, or broker wagers, and nothing on the Service is betting, financial, or professional advice. Projections are statistical estimates derived from public data. They are frequently wrong, in ways we document at /method and in our public record. We make no representation or warranty about the accuracy of any projection. If you choose to wager, that decision and its consequences are yours.

2. Your responsibility for your decisions

Any decision you make using the Service — including fantasy roster decisions and any form of wagering — is yours alone. You are responsible for complying with the laws of your jurisdiction, including age and legality requirements for any wagering activity. If you or someone you know has a gambling problem, help is available: call or text 1-800-GAMBLER (US).

3. Eligibility and the Thursday email

You must be at least 18 years old to use the Service. No account is required for any part of the site. If you subscribe to the optional Thursday email, you confirm your address by a one-click link, you are responsible for the security of your email account, and you may unsubscribe at any time from any issue. We may stop sending to addresses that violate these terms.

4. Acceptable use

The line is kickoff. Before a game kicks off, its projections are live — the perishable product. From kickoff, the forecast is dead: citing the locked number is grading us, even before the results page exists.

Live projections (before kickoff):

You may not use automated means to scrape, crawl, or bulk-capture them; republish or redistribute the live slate in whole or substantial part; or build a competing feed, dataset, or product from them.

Permitted, and encouraged: quoting individual live projections publicly — in articles, podcasts, streams, or social posts, including a screenshot of a player's card — with attribution to Saidmark.

The graded archive is the public record. Read it, link it, cite it, quote it, and compile from it — including building your own table of how Saidmark's projections performed. We will never prohibit you from grading us. What you may not do is resell the archive as a live data product or present it as your own work.

You also may not use automated means to bulk-capture the live board, or interfere with the operation of the Service. (A person browsing many pages is browsing; these restrictions are about automation.)

5. Intellectual property and data sources

The Service's projections, text, design, and compilation are our work product. Underlying NFL play and roster data is used via the nflverse project (CC-BY 4.0); NFL team and player names are the property of their respective owners. Saidmark is independent and is not affiliated with, endorsed by, or sponsored by the NFL, any team, any player, or any sportsbook.

6. Free service; changes; contributions

The Service is currently free. We may introduce paid features, modify, suspend, or discontinue any part of the Service at any time. Free access today is not a promise of free access tomorrow. Before introducing paid features or making material changes to these terms, we will post notice on the site and, if you subscribe to the Thursday email, send notice to that address. Continued use after the effective date of a change is acceptance.

Voluntary contributions. We may offer a way to support the record with a voluntary contribution. Contributions are voluntary and non-refundable; they do not purchase goods, services, access, or any obligation from us; and they are not charitable donations and are not tax-deductible.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND ACCURACY. We do not warrant that the Service will be uninterrupted, timely, or error-free.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, OR FOR ANY WAGERING OR OTHER FINANCIAL LOSSES, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS.

9. Indemnification

You agree to indemnify us against claims arising from your violation of these terms or your misuse of the Service.

10. General

Assignment. We may assign these terms — for example, to a limited liability company that succeeds the Saidmark trade name, or to a successor in a sale of the Service. You may not assign your account or these terms. Survival. Sections 5 (intellectual property), 7 (disclaimers), 8 (limitation of liability), and 9 (indemnification) survive termination of your account or of the Service. Severability. If any provision is held unenforceable, the rest remain in effect.

11. Governing law and disputes

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules.
